Please read the following carefully before submitting
an application.
1. The Hampstead Easter School Limited, registered in England &
Wales, number 5701611, is hereinafter referred to as HES.
2. The agreement for the supply of services by HES is between the
Student, his/her Parent, and/or the Fee Payer (if different) on
one part, and HES on the other. If the Student is a minor, his or
her Parent or Guardian is responsible for him/her at all times and
thus for ensuring that he/she complies with this agreement. The
person or
persons making the application are wholly responsible for ensuring
that the Parent, Guardian and Student (if different and as the case
may be) are aware of and understand and agree to these terms.
3. Registrations are only accepted by HES once a valid and complete
Application Form has been received in the form of electronic or
hard copy together with correct details of relevant Specification/Syllabus/Unit
Codes/Tiers, and the Course Fees have been paid in full. Ultimately
it is the responsibility of the Fee Payer to ensure that this information
is provided. HES will in no way be responsible for acting on incorrect,
incomplete or inaccurate information supplied. No student is accepted
until HES confirms acceptance in writing/eMail.
4. Students should note that if they register for the incorrect
Awarding Body/Examination Board or/& Specification/Syllabus
relative to their actual requirements, they may find themselves
in the wrong group, one not best suited to their needs. If, as a
result of lack of information or misinformation provided to HES,
it is decided that a student will not benefit fully from such a
class or/& hinder the progress of other students in the group,
HES reserves the right to terminate the students class without
further notice. In such a case no refund of the Course Fees would
occur.
5. In the event of the Schools being unable to accept a student
for a course the fees paid will be returned.
6. Course Fees vary with the date of receipt of an Application as
advertised currently at hes.org.uk and HES reserves the right to
alter these as it sees fit.
7. Students and their parents/guardians are jointly and individually
liable for any damage caused by them to the premises used by HES,
including the property of any organization or party connected with
HES.
8. HES reserves the right to terminate the Course or Courses of
any student whose conduct or approach is viewed as unsatisfactory
and/or unacceptable by HES, the Tutors and Staff, or the staff of
the Course Venue provider. Where the variable attendance, punctuality,
attitude or approach of a Student is deemed detrimental to the
continuing sound progress of any HES class, then HES reserves the
right to terminate that and any future Courses that a Student is
registered for. In all such cases the unexpired amount of all Course
Fees is not refundable.
9. HES reserves the right to vary the arrangements or cancel an
advertised course, including changes to Teaching Staff. Should circumstances
demand, timetables may be altered at short notice while making all
reasonable efforts to keep the student informed in advance of such
changes, consistent with the contact information provided for the
Student, e.g., telephone number(s), eMail plus a Students mobile
number so as to be able receive SMS messages.
10. Note that where classes are available in the mornings
or/& afternoons, HES cannot guarantee that it will
be able to satisfy any requests for specifically mornings
or afternoons due to scheduling and maintenance of suitably-appropriate
class sizes. HES will confirm whether your classes are in the mornings
or afternoons either one week (7 calendar days) before commencement
of your HES Revision Programme or, for Multiple-course Applications,
not later than at Registration.
11. If it is impossible to form a group of at least two students
for an advertised course in a subject, the following options will
apply:
(a) a full refund for the component part of the course can be requested;
(b) as an alternative to (a) and only if possible, HES will provide
individual tuition charged at £60 per hour.
Note that where any tuition arranged in advance is scheduled to
take place on an individual basis (1:1) the fee per hour is £60.
12. Changes to any components of an existing application may be
made with the following provisos:
(a) there is availability on the new course;
(b) an Administration Fee of 5% of the cost of the original course
component is paid;
(c) any difference in Course Fees and other charges applicable at
the time the change is made are paid in respect of any new course
component(s).
Note that cancellation of any course by the Student or/& Parent/Guardian
is not considered as a change to a booking but is treated separately
as in 15. & 16. below.
13. In the event of cancellation of a complete course by HES the
fee paid is refundable in full. At its discretion, in the unlikely
event that a course has been started but can not be completed, a
commensurate proportion of fees will be refunded.
14. Narrative reports are provided for all students attending full
GCSE or IGCSE Courses (i.e., five half-day or four half-day courses)
plus GCSE Additional Science and IGCSE Science Double Award, but
not for English Literature Texts, Geography or History Units. Reports
are issued for AS & A2 subjects where a student attends two
or more AS or two or more A2 Units in that subject. Reports are
issued for all IB and pre-U Courses. In any other circumstances
reports will not be issued unless agreed in writing beforehand by
the Local Course Director.
15. For cancellations by or on behalf of the Student in advance
of a course, partial refunds are considered only in the case of
serious illness and in any event wholly at the discretion of the
Senior Course Director. Production of a certificate from a Medical
Practitioner, consistent with the reason for absence, will be required.
Any cancellation must be notified in writing addressed to the Registered
Office. Once a course has commenced, non-attendance due to illness
can not be considered for reimbursement and neither can separate
arrangements be made to redress any commensurate deficiency in the
number of hours of tuition received.
16. HES accepts no liability for the attendance or non-attendance
of a Student, or for the attitude and approach of a Student attending
a course. In the case of student absence from a course additional
tuition cannot be provided to make up for the ensuing shortfall.
17. If other extenuating circumstances result in cancellation, and
providing the Senior Course Director considers that these merit
due consideration, then the amount of the refund will vary with
the time of cancellation according to the following scale:
(a) for notification more than 30 days before the start of the course
a maximum of a 75% refund will be due;
(b) for notification between 14 and 29 days before the start of
the course a maximum of a 50% refund would be due;
(c) for notification less than 14 days before the start of the course
no refund would be due.
18. HES uses its reasonable endeavours to provide the educational
services advertised, and to a reasonable standard. However, HES
can give no guarantees of any level of result to be achieved as
a consequence of a Student attending any HES course.
19. Payment of the Course Fee is deemed acceptance of these terms.
20. Statutory rights are not affected by these Terms and Conditions.
